• Users are prohibited from reverse-engineering, modifying, or misusing the software or Services in any unauthorized manner. Misuse includes, but is not limited to, excessive automated querying, unauthorized scraping, or overloading our servers.

1.3 User Responsibilities

• Users must ensure the accuracy and legality of the data they input into the platform.
• Users are responsible for obtaining all necessary consent before utilizing the Services for bookings or other purposes.
• If operating outside India, Users must ensure their use of the Services complies with local laws and regulations.

2. Data Privacy and Security

2.1 Compliance with Laws

We comply with Indian data protection laws, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (DPDP Act), and associated live music regulations and guidelines.

2.2 User Data

• Users retain ownership of all data submitted through the platform. By using the Services, you grant us a limited license to process the data solely for providing the Services.
• Data processing is carried out in accordance with data minimization principles and solely for the purposes specified in these Terms.

2.3 Consent Management

Users are solely responsible for obtaining explicit and informed consent, as required under applicable laws, prior to processing their data using our Services.

2.4 Security Measures

• We implement reasonable security practices and procedures, including encryption and access controls, to protect sensitive personal data from unauthorized access, use, or disclosure.
• In the event of any suspected or confirmed data breach, Live Gig will promptly notify the User and cooperate with investigations to ensure compliance with applicable laws, including the DPDP Act.

For sensitive personal data, including bookings data, additional safeguards are applied. Users must ensure that consent specifies the purpose of such data collection explicitly.

2.6 Privacy Notice

• Users are solely responsible for drafting, delivering, and ensuring the compliance of privacy notices provided to their partners.
• Live Gig may provide optional tools or templates to assist Users in creating privacy notices, but the final responsibility for compliance lies with the User.

2.7 Data Retention and Deletion

• Customer Data is retained only as necessary to provide the Services or as required by law. Upon termination of the Services, data will be securely deleted or anonymized unless otherwise requested by the User.
• Users have the right to request data access, correction, export, or deletion in compliance with applicable laws.

2.8 Cross-Border Data Transfers

If Customer Data is transferred outside India, Live Gig ensures compliance with Indian data localisation requirements and provides adequate safeguards for data protection.

3. Intellectual Property

3.1 Ownership

All intellectual property rights in the Services, including but not limited to the software, design, logos, and content, belong to Fursat Farms Private Limited or its licensors.

3.2 User Content

You retain ownership of the content you submit but grant us a license to use it for providing and improving the Services.

3.3 Restrictions

You may not reproduce, distribute, or create derivative works from any part of the Services without prior written consent from us.

4. Bookings and Payment

4.1 Fees

Any disputes shall be subject to arbitration in Bangalore, India, in accordance with the Arbitration and Conciliation Act, 1996. The language of arbitration shall be English.

8. Amendments

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting on our website. Continued use of the Services constitutes acceptance of the revised Terms.
